These terms and conditions of use (the "Terms") govern the contractual relationship between (a) Prima Luxury Real Estate Broker LLC, a corporation organized and existing under the laws of Dubai, UAE, with an office address at Fairmont Hotel, Office 520, Sheikh Zayed Road, P.O. Box 46685, Dubai, UAE referred to as "Prima Luxury", "we", "us", and (b) any individual referred to as "User" or "you", accessing or visiting the website [www.primaluxury.com] (the "Site", "Website") and/or using the property search, enquiry and registration of interest features (the "Services") offered by Prima Luxury on the Website.

To access the Site or use the Services, the User declares that they are at least 18 years old. The Services are intended for the User's personal or investment use.

Use of the Site or the Services implies acceptance of these Terms, without reservation. Prima Luxury may update these Terms at any time. In every case, the applicable Terms are those in force at the time the User accesses the Site or uses the Services.

1. Description of the Services

  • The Website is operated by Prima Luxury, a luxury real estate advisory firm serving across the UAE. It provides property listings, off-plan project information, market insights, editorial content and enquiry tools.
  • Through the Website, the User may browse listings and projects, submit an enquiry, register interest in a property or project, request a call back, and subscribe to newsletters and market updates.
  • Listings, prices, floor plans, images, renders, brochures, availability and payment plans are indicative. They are provided by owners, developers and other third parties and may change without prior notice. Final details are confirmed only in the relevant written agreement.
  • Submitting an enquiry or registering interest is an expression of interest only. It does not constitute a reservation, booking, offer or a binding agreement of any kind. Any brokerage relationship or property transaction arises only under a written agreement signed in accordance with applicable UAE and Emirate-level regulations.
  • Market insights, articles, guides and other editorial content are shared for informational purposes. They do not constitute financial, investment, legal, tax, immigration or real estate advice, including any content relating to residency and Golden Visa eligibility.
  • Prima Luxury takes care to keep the Website accurate and current. The User acknowledges that Prima Luxury does not guarantee the accuracy, reliability, timeliness or completeness of any content on the Website, and that any reliance placed on it is at the User's sole discretion and risk.
  • Prima Luxury shall not be liable for any direct, indirect, incidental, consequential or special damages arising out of or in connection with the use of the Site or the Services, including decisions made or actions taken in reliance on Website content, or on any subsequent email, SMS, WhatsApp message or other notification received under our brand name.
  • The Site and the Services are offered "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • Prima Luxury reserves the right, at its sole discretion, to modify, suspend or discontinue any part of the Site or the Services at any time and without prior notice, and shall not be liable for any consequences resulting from such changes or interruptions.

2. User Obligations

  • By accessing the Site and using the Services, the User agrees to use them in accordance with these Terms and all applicable laws and regulations of the United Arab Emirates.
  • The User undertakes to provide accurate, complete and current information when using the Services. Prima Luxury shall not be liable for any inaccurate or misleading results arising from incorrect, incomplete or outdated information provided by the User.
  • The User agrees to use the Site and the Services for lawful purposes only, and in a manner that supports the proper functioning of the Site and the experience of every other visitor.
  • The User shall not engage in data mining, data harvesting, data extraction or any similar activity in relation to the Site or the Services. Nor shall the User attempt to gain unauthorized access to any section of the Site or to any systems or networks connected to it, through hacking, password mining or any other means.
  • Use of the Site or Services in breach of these Terms may result in the suspension or termination of access at Prima Luxury’s sole discretion, without prejudice to any other legal remedies available to us.

3. Intellectual Property Rights

  • All content and materials available on the Site, including text, graphics, logos, icons, images, photography, audio, video, software, and the layout, design and structure of the Site (collectively, the "Content") are the exclusive property of Prima Luxury. They are protected by applicable copyright, trademark and other intellectual property laws of the UAE and international treaties.
  • Project names, developer logos, renders and brochure materials featured on the Site remain the property of their respective owners and are shown with their permission or under license.
  • Except as expressly permitted under these Terms or with prior written consent from Prima Luxury, the User shall not:
    • Copy, reproduce, modify, adapt, create derivative works from, distribute, transmit, display, publish, sell, license or otherwise exploit any Content for any commercial purpose;
    • Reverse engineer, decompile, disassemble or otherwise attempt to discover the source code or architecture of the Site or any of its features;
    • Use any trademarks, service marks, trade names or logos of our brand or its partners without express prior written authorization.
  • Nothing in these Terms grants, by implication or otherwise, any license or right to use any of Prima Luxury's or any third party's intellectual property without written permission.

4. Disclaimers and Limitation of Liability

  • General disclaimer
    The Site, the Services and all related content (collectively, the "Information") are provided solely for general informational purposes and serve as a guide only. Nothing on the Site constitutes professional advice, or an offer or contract for sale, lease or any other form of binding agreement. 7. Governing Law and Dispute Resolution

  • All matters relating to the Website and these Terms, and any dispute or claim arising from or related to them (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws in force in the Emirate of Dubai, United Arab Emirates, without giving effect to any choice or conflict of law provision or rule of the United Arab Emirates or any other jurisdiction.

  • Any legal suit, action or proceeding arising out of or related to these Terms or the Website shall be instituted exclusively in the courts of Dubai, United Arab Emirates.

    We retain the right to bring any suit, action or proceeding against the User for breach of these Terms in the User's place of residence or any other relevant country. The User waives any objections to the exercise of jurisdiction over them by such courts and to venue in such courts.

8. Waiver and Severability

  • A waiver by Prima Luxury of any term or condition of these Terms shall not be considered a continuing waiver of that term or condition or of any other term or condition. Failure to enforce any right or provision under these Terms shall not constitute a waiver of that right or provision.
  • If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable, that provision shall be eliminated or limited to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

9. Entire Agreement

  • These Terms, the Privacy Policy and the Cookie Policy constitute the sole and entire agreement between the User and Prima Luxury with respect to the Website.
